VoipJet: Terms and Conditions

THE CUSTOMER AGREES TO READ THIS DOCUMENT COMPLETELY. This agreement begins effect immediately upon usage of VoipJet's products and services, whether purchased or obtained freely, and consititues a legally binding agreement. If, at any time, the customer does not agree to all of the following terms then the party should immediately notify VoipJet and discontinue all usage of products and services.
THIS IS A SERVICE FOR WHOLESALE CUSTOMERS ONLY AND NOT FOR END USERS. THE CUSTOMER WILL ENSURE THAT THEY ARE LEGAL ENTITIES THAT ARE ALLOWED TO PURCHASE WHOLESALE TERMINATION IN THEIR COUNTRY. As wholesaler, you are responsible for collecting from your customers and remitting to your government any applicable taxes in your country of business. This will not be done for you. For example, by paying for our services you have not been charged and have not paid VAT (Europe), USF (America) or GST/PST (Canada). THE CUSTOMER SPECIFICALLY AGREES TO NOT KNOWINGLY USE THE SERVICE TO COMPLETE CALLS THAT BOTH BEGIN AND END WITHIN THE COUNTRY OF CANADA.
THIS SERVICE COMES WITH NO WARRANTY, expressed or implied, including but not limited to merchantability or fitness for a particular purpose, regarding its products or services. VoipJet shall not be held liable for failure of service, either expected or implied, at any time. VoipJet, its ownership and managment, all shall not be held liable for direct or indirect loss of revenue or profits arising due to failure of VoipJet service at any time. Furthermore, it is recommended that the customer has public switched telephone network (PSTN) backup for all services rendered.
THIS SERVICE DOES NOT PROVIDE EMERGENCY 911 SERVICES.
The customer will NOT send telemarketing, broadcast, auto dialer or call center traffic.
THE CUSTOMER SHALL ENSURE ITS CUSTOMERS FULLY COMPLY with the Do Not Call Provisions of the United States FTC's Telemarketing Sales Rule, including but not limited demonstration that (1) it has written procedures to comply with the do not call requirements, (2) it trains its personnel in those procedures, (3) it monitors and enforces compliance with these procedures, (4) it maintains a company-specific list of telephone numbers that it may not call, (5) it accesses the national registry no more than 31 days before calling any consumer, and maintains records documenting this process, (6) any call made in violation of the do not call rules was the result of an error.
The customer agrees to have their email address on the VoipJet mailing list at all times during usage of service.
The customer may request a full refund of unused credit from VoipJet within thirty (30) days of deposit, less transfer charges. Dormant accounts, which have no activity, will be closed after six (6) months and any remaining refunds forfeit.
The customer understands that all materials on the VoipJet website are intellectual property of VoipJet and may not be copied or used as part of marketing with written consent from VoipJet.. "VoipJet" and "Rapid-IP transit" are trademarks of VoipJet Inc.
The customer agrees to safeguard their username, password and connection string information. The customer is responsibile for all usage on their account. Users with dynamic IPs understand the additional risk they face, and will not keep large amounts of money in their accounts at any given time. Customers with static IPs will inform VoipJet of changes to their static IP address(es) immediately and without fail.
The customer will inform VoipJet of any payment or billing disputes with three (3) business days of their occurence. Suspected breach of username/password/dial string will be communicated to VoipJet within one (1) hour of the suspicion.
This contract and professional relationship shall be governed by the laws of Canada, in the province of Alberta. The customer agrees to submit to this exclusive jurisdiction of these courts, only.
